The state of Michigan has restrictions on what can be reported in a background screening report beyond what the Fair Credit Reporting Act (FCRA) dictates.
Restriction | Explanation |

Prohibits salary history inquiry during hiring process | State and local governments are prohibited from inquiring about an applicant's past salary, per Executive Directive 2019-10. |
Use of arrest record with no conviction | Employers may not consider an arrest for a misdemeanor that did not result in a conviction. See the statute here for more information. |
Use of Social Media Password Information | Employers may not request user names or passwords of an applicant/employee’s personal websites or social media. There may be exceptions for employee misconduct and investigations. See the statute here for more information. |
