The state of Montana has restrictions on what can be reported in a background screening report beyond what the Fair Credit Reporting Act (FCRA) dictates.

Use of Social Media Password Information | HB 343, signed by the Governor on April 23, 2015, prohibits request of online passwords as a condition of hiring or employment. An employer or employer's agent may not require or request an employee or an applicant to disclose a user name or password for the purpose of allowing the employer or employer's agent to access a personal social media account.
