The state of North Carolina has restrictions on what can be reported in a background screening report beyond what the Fair Credit Reporting Act (FCRA) dictates.
Restriction | Explanation |
---|---|
Use or inquiry of sealed, expunged, pardoned or erased records | Effective December 1, 2013, an employer or educational institution is prohibited from knowingly and willingly requesting information regarding an arrest, criminal charge, or criminal conviction of the applicant that has been expunged. Applicant/employee may state that he/she has no arrest/ conviction. See the statute here for more information. |
