Automated Adverse Action Process Simplified
We understand the pre-adverse and adverse process can be challenging for many companies, and that’s why AccuSource provides a unique feature to help streamline this process. With an integrated tool for our clients, we make it convenient and easy for you to notify candidates, while getting rid of the excessive paperwork.
If you choose to make an adverse action based off the report information provided from AccuSource, you’ll want to take the following actions. Please note, there is a two-step notification process to ensure compliance with the FCRA.
Orally, in writing, or via electronic communication, notify the candidate of pre-adverse action by providing the candidate with:
- The name, address, and telephone number of AccuSource.
- Notice that AccuSource did not make the adverse decision and that they are unable to provide an explanation as to why such decision was made.
- A copy of the background report obtained on the candidate.
- A copy of “A Summary of Rights Under the FCRA”.
- Notice of his/her right to contact AccuSource directly to dispute inaccuracies or incomplete information on their background report.
- Notice that they have the right to obtain a free copy of their report within 60 days
Once the pre-adverse notice is provided, you’ll want to allow the candidate 5 business days to contact AccuSource to dispute the findings on the report if necessary. If after 5 days, you do not hear from the candidate or AccuSource you may proceed with your final employment decision.
When making a final adverse decision, you should always send the candidate a final adverse action letter.
